Introduction
Interactive Entertainment and Innovation Council (“IEIC”) is hosting The Tech Triumph (“Contest”) which inter-alia gives the game developers, other companies and students (“Participants/ you/your”) a chance to showcase their products to the global gaming ecosystem. These terms & conditions (“Terms”) govern the participation of the Participants in the Contest. Some of the prizes are being sponsored by WinZO Games Private Limited (“WinZO”) and other persons who may join as sponsors from time to time (collectively referred to as “Sponsors”). IEIC and Sponsors are together referred to as the “Organizers”.
Kindly review the entire contents of the Terms before participating in the Contest. By submitting the form for participating in the Contest you agree to be bound by these Terms.
Unless and to the extent specified otherwise, nothing contained herein will apply to the participation of Students under the Tech Triumph Case Study Challenge, as described in detail, later.

Eligibility
The following persons are eligible to participate in the Contest for multiple categories:-

Interactive entertainment ecosystem members: Developers, studios, and startups creating mobile games, gaming-related technology, or supporting products and services.

Indian entities at any stage of development: Alpha, beta, or live/open products are welcome, but a working prototype is mandatory.

Indian-registered companies: Open to all sizes and ages, regardless of the number of employees.
- Individuals: Any individual including students creating or developing mobile games, gaming-related technology or any other similar products.
Individuals participating in the Contest should be resident Indian citizens who have attained the age of majority (18 years). Non-individuals participating in the Contest must be incorporated/registered in India prior to the date of submission of participation form.
Organizers may, on their sole discretion, bar a Participant from the Contest without assigning any reason. If the Participant is unable to or is prohibited under applicable law from receiving any prizes then the Participant shall not be eligible for participating in this contest.
Organizers may in their sole discretion amend the eligibility criteria or allow a person who does not satisfy any eligibility criteria to participate in the Contest in its sole discretion.

Judging criteria
Each submission will be judged by a panel of experts selected by persons appointed by Organizers from time to time (“Jury”). The Jury will evaluate the submissions made the Participants on such relevant criteria as may be deemed fit, including:-
- Quality and Diversification
- Product
- Pitch
- Team
- Category of entry
- Any other criteria determined by the Jury in its sole discretion
The decision of the Jury regarding the winner of the Contest will be final and binding on all the Participants and cannot be challenged.

Contest categories and details rounds
The Contest will have multiple categories including gaming for open theme, esports, gaming for good, games for skilling (gamification of skills) and your application will be considered for the category in which you have applied.
All the timelines related to the Contest including but not limited to the last date of submissions, date of declaration of results of respective rounds, pitch date to the jury etc will be announced on thetechtriumph.com. Participants are requested to check the afore-said website at regular intervals for the relevant dates. Organizers reserve the right to change the dates and timelines provided herein at their sole discretion without providing prior intimation. Participants must regularly visit the afore-said websites to keep themselves abreast of the timelines.

Media coverage
Organizers may promote the Contest through appropriate media, as per their sole discretion from time to time. Such media may include, without limitation, Organizers’ website, blogs, social media posts, joint press coverage, job postings, webinars etc and through various mediums including written articles and videos. By participating in the Contest, you agree to be featured in the promotional materials and provide necessary support in curation of the materials including by giving interviews as may be required by Organizers from time to time.

Intellectual Property Rights
You confirm that you own all the intellectual property rights in the games and all other submissions whatsoever made by you in relation to the Contest (“Deliverables”). The submission of Deliverables will not constitute a violation of any rights including intellectual property rights, privacy rights of any person. You agree to keep Organizers harmless and indemnified against any losses, claims, damages, fees, liability, costs, (including reasonable attorney costs) or the like incurred by Organizers due to any violation of this clause.
You grant Organizers an irrevocable, non-exclusive, non-transferable except to successor-in-interest, worldwide and royalty-free license to use the Deliverables for the purpose of and in relation to the Contest including but not limited to showcasing the Deliverables or any part thereof in the Gaming Conferences (defined later).
Your participation in the Contest does not entitle you to use any intellectual property rights including but not limited to the trademark or logo of Organizers or any other Participant of the Contest unless approved by Organizers in writing.

Changes to the Contest
Organizers may at their sole discretion make any changes in relation to the Contest as they may deem fit, including:-

Change the relevant dates or timeline of the Contest

Change these Terms

Change the composition of the Jury

Change the eligibility criteria

Cancel the Contest

Modify the Prizes
Any change to the Contest will be posted on the webpage dedicated to the Contest. Organizers do not and Participants acknowledge that Organizers do not have any obligation to communicate any change to the Participants. Participants must regularly visit the webpage to keep themselves abreast of the changes.

Prize
The winner will receive the following Prize:
- The potential to participate in one or more of the following:-
- Waves 2025 (“Waves 2025”)as and when organized by the respective organizers.
- Game Developer Conference, 2025 to be organized in San Francisco, USA, (“GDC 2025 ”) details available here.
Waves 2025 and GDC 2025 are collectively referred to as “Gaming Conferences”. The winner can attend such Gaming Conference(s) as determined by Organizers keeping in mind (a) the specific Gaming Conference; (b) the nature of the winner i.e whether the winner is an individual, company etc; (c) the the quality and type of Deliverables, e.g the kind of game/gaming technology or (d) such other criteria as determined by the Organizers.
- Airfare Fare/relevant travel sponsorship for attending such Gaming Conference as determined by the Organizers from time to time.
- Passes for the Gaming Conference as determined by the Organizers from time to time: explore the Gaming Conference, attend talks, network, and build lasting connections.
- Investment Potential from ZO Fund: Your winning game could catch the eye of the ZO Fund, opening doors to funding and support.
- Certificate of Achievement: Celebrate your well-deserved victory with a prestigious certificate recognizing your talent and innovation.
- Complimentary Interactive Entertainment and Innovation Council Membership: Gain exclusive access to valuable resources and networking opportunities
It is hereby clarified that participation in the Gaming Conference, airfare/relevant travel sponsorship for attending the relevant Gaming Conference, passes for the relevant Gaming Conference and all the benefits arising from or related to the Gaming Conferences (“Gaming Conference Benefits”) will be awarded to such winners as may be determined by the Organizers from time to time. Organizers will have the sole discretion to determine the winners who may attend any Gaming Conferences and obtain any Gaming Conference Benefit. The decision of the Organizers in this respect will be final.
Notwithstanding anything contained herein, Prize will be awarded subject to the winner complying with the Terms, fulfilling the eligibility criteria and meeting any other requirements that may be outlined by Organizers at their sole discretion from time to time including obtaining visas of the attendant/providing data/media required for setting up of the booth and additional undertakings within the time limit determined by Organizers.
The Participant will not be entitled to exchange or trade the Prize or transfer it to or for the benefit of any person in any manner whatsoever except as approved in writing by Organizers. If the winner does not fulfill the eligibility criteria and/or meet additional requirements that may be outlined by Organizers the Participant shall refund the prize amount equivalent to the Prize or a reasonable sum in lieu of the Prize as communicated by Organizers. Organizers may at any time cancel the Prize or participation of the Participant if the Participant, in the opinion of the Organizer, acts in an unethical manner, has cheated or committed fraud, or the Participants association with Organizers/the Contest may, in the sole opinion of Organizers, harm the goodwill of the Contest or Organisers, etc., or due to COVID-19, government travel restrictions or general travel advisory, or for such other reasons that Organizers may deem appropriate.
Prize(s) will be distributed by Organizers subject to any applicable taxes or statutory deductions. The Participant shall be responsible for paying all taxes as may be applicable on the Prizes upon receipt.
Prize will be awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). Winner cannot claim (a) Gaming Conference Benefits and/or (b) funding/investment from ZO Fund as a matter of right and Gaming Conference Benefits and any investment by ZO Fund under this Contest is subject to further analysis and evaluation by the investment team of ZO Fund.
There are no alternatives to Prize(s). If any selected Participant does not respond back to any communications sent in relation to the Contest within the time period communicated by Organizers, they may be declared ineligible to obtain the Prize. Organizers reserve the right to determine an alternative winner in such circumstances.

Data Protection
Participants will comply with applicable data protection and privacy laws. The Participant agrees that Organizers may process personal information including government identification cards supplied pursuant to the Contest for the purpose of organizing the Contest and carrying out its obligations mentioned hereunder.

Governing law and jurisdiction
These Terms will be governed by and construed in accordance with laws of India.
Any dispute arising out of or in relation to these Terms will be settled by arbitration conducted as per arbitration and conciliation act, 1996. The arbitration tribunal will consist of a sole arbitrator mutually appointed by Parties to the dispute. The proceedings will be conducted in New Delhi in English language. The cost of arbitration will be equally divided amongst the parties to the dispute.

Miscellaneous

No commitment to announce a winner: Organizers make no assurances about announcing a winner of the Contest.

Limitation of Liability: In no event will Organizers be liable for any indirect, incidental, special or consequential damages, including loss of profits, revenue, data, or use, incurred by Participants or any third party, whether in an action in contract or tort, in any way arising from any person’s performance or non-performance of these Terms, even if the Participants or any other person has been advised of the possibility of such damages. Organizers’ maximum liability arising under or in connection with the Contest, to the Participants or its affiliates, will in no event exceed INR 500.

Discrepancy: Organizers will have the sole right to resolve any discrepancy with regard to the Terms. Any decision by Organizers including with respect to interpretation of these Terms will be final and binding on all the Participants.

Execution of documents: Organizers may require the selected Participants/winners to execute such documents and/or provide further actions/undertakings/documents/media and if the Participant/selected winner fails to execute the requisite documents and/or provide such actions/undertakings/documents/media then such Participant/selected winner shall have deemed to have forfeited the Contest and the Prize.

Relationship: These Terms will not in any way create a relationship of principal-agent between the Participants and Organizers. All dealings between the Participants and Organizers will be on a principal-to-principal basis. None of the provisions of these Terms shall be deemed to constitute a partnership between the Participants and Organizers hereto and no Participant have any authority to bind Organizers in any way.

Indemnity: The Participant agrees to keep Organizers (its directors, officers and employees) harmless and indemnified against any losses, fees, fines, claims, damages, costs, (including reasonable attorney costs) incurred by Organizers due to any violation of these Terms and breach of applicable law by the Participant.

Force Majeure: Without prejudice to its rights under clause 7 and 8, Organizers may modify or cancel the Contest/Prize if it is prevented from carrying out its obligations under the Terms for reasons beyond its control including, act of god, Covid, pandemic, epidemic, government advisory, war, act of terrorism, cancellation of Gaming Conference(s) etc.

Terms for Tech Triumph Case Study Challenge
- Introduction
The Organizers may also conduct case study challenges for students only (“Tech Triumph Case Study Challenge”). Students may participate in the Tech Triumph Case Study Challenge in teams of 1 to 3 students or in such other numbers as may be decided by the Organizers from time to time. The winners of the Case Study Challenge will be determined by the Organizers in their sole discretion and these winners will receive prizes as announced by the Organizers from time to time in their sole discretion. The decision of the Organizers including but not limited to the choice of the winner, the prize and all the aspects pertaining to the Tech Triumph Case Study Challenge will be final and binding on all the Participants. These terms (“Case Study Challenge Terms”) govern the students participation in the Tech Triumph Case Study Challenge. Kindly review these Case Study Challenge Terms before participating in the Tech Triumph Case Study Challenge.
Capitalized terms used but not defined herein will have the same meaning as defined in the Terms for Tech Triumph Contest.

Eligibility
Students who have attained the age of majority and are currently enrolled in courses of a legally recognized university in India are eligible to participate in the Case Study Challenge. All the participants must be resident Indian citizens and must hold a valid identification card issued by their respective university.
Organizers may, on their sole discretion, bar a Participant from the Case Study Challenge without assigning any reason. If the Participant is unable to or is prohibited under applicable law from receiving any prizes then the Participant shall not be eligible for participating in the Tech Triumph Case Study Challenge.
Organizers may in their sole discretion amend the eligibility criteria or allow a person who does not satisfy any eligibility criteria to participate in the Case Study Challenge in its sole discretion.

Topic
The topic(s) of the Case Study Challenge and all the stages, requirements will be solely determined by the Organizers and will be communicated to the Participants from time to time.

Other terms and conditions
Clause 5 (Media Coverage), 6 (Intellectual Property Rights), 9 (Data Protection), 10 (Governing Law and Jurisdiction) and 11 (Miscellaneous) of the Contest Terms will apply mutatis mutandis to the Tech Triumph Case Study Challenge.
Notwithstanding anything else contained herein, the Organizers may amend or make additions to these Case Study Challenge Terms in any manner whatsoever including but not limited to change in eligibility criteria, prizes, topics etc.
